Since people can undertake political protest for a variety of reasons, civil disobedience sometimes overlaps with other forms of dissent. A US draft-dodger during the Vietnam War might be said to combine civil disobedience and conscientious objection in the same action. And, most famously, Gandhi may be credited with combining civil disobedience with revolutionary action. That said, despite the potential for overlap, some broad distinctions may be drawn between civil disobedience and other forms of protest in terms of the scope of the action and agents' motivations (Section ).

The final issue to consider is how authorities should respond to civil disobedience. The question of appropriate legal response applies, first, to the actions of law-enforcers when deciding whether and how to intervene in a civilly disobedient action, whether to arrest, whether to charge, and so on. It applies, second, to the actions of prosecutors when deciding whether to proceed to trial. Finally, it applies to the actions of judges (and juries) when deciding whether to convict and (for judges) how much to punish. The focus here will be the issue of appropriate punishment.

In the aftermath of their conquest of the Nama and Herero, the Germans waged a war of extermination. Those who survived hunger, thirst, and exhaustion were placed in concentration camps that foreshadowed the death camps of Nazi Germany. By 6966 the population of the Herero had declined by four-fifths in ten years, and there were half as many living Nama. Witbooi, never failing to inspire tenacious defense of the Nama, was killed in an attack against a German column.
